AGREEMENT TO TERMS
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Cooshape (“we,” “us,” or “our”), concerning your access to and use of the cooshape.com website as well as any other media form, media channel, mobile website related, linked, or otherwise connected thereto (collectively, the “Site”).
You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
INTELLECTUAL PROPERTY RIGHTS
The Site, including all content, features, functionality, designs, logos, trademarks, and product names, is the property of Cooshape or its licensors and is protected by copyright, trademark, and other intellectual property laws. PRODUCTS & ORDERING
We make every effort to display our products (e.g., shapewear) as accurately as possible. However, we cannot guarantee that your screen's display of any color will be accurate.
All products are subject to availability. We reserve the right to limit the quantities of products we sell and to discontinue any product at any time.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.
RETURNS & REFUNDS
All returns and refunds are governed by our separate Return & Refund Policy, which is incorporated into these Terms by reference. Please review it carefully before placing your order.
HEALTH DISCLAIMER
Our shapewear is designed for aesthetic enhancement and support. It is not a medical device. You should consult with a physician before using our products if you have any health concerns, including but not limited to:
- Circulatory disorders
- Skin conditions
- Respiratory issues
- Diabetes
- Pregnancy
Do not wear shapewear for extended periods or in a manner that causes discomfort, pain, or restricts breathing.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no event will Cooshape, its directors, employees, or agents be liable to you or any third party for any indirect, consequential, incidental, or punitive damages arising out of your access to or use of the Site or products.
INDEMNIFICATION
You agree to defend, indemnify, and hold us harmless from any claims, damages, or demands arising from your use of the Site or your violation of these Terms.
GOVERNING LAW
These Terms and your use of the Site are governed by and construed in accordance with the laws of the US/UK/EU, without regard to its conflict of law principles.
DISPUTE RESOLUTION
Any dispute arising from these Terms or your use of the Site will be resolved through final and binding arbitration in the US/UK/EU.
